1. Parties and Definitions

These Terms of Use ("Terms") regulate the procedures and principles regarding the use of services offered through the website and online platform ("Platform") operated by:

("HOTELSURF" or the "Company").

Individuals who use the Platform are referred to as "User" or "Consumer."

2. Legal Status of HOTELSURF

2.1. HOTELSURF is a platform that intermediates the online sale of hotels and accommodation services.

2.2. HOTELSURF is not the provider of accommodation services.
Accommodation services offered through the Platform are provided by third-party establishments such as hotels, hostels, apartments, resorts, and similar accommodation facilities.

2.3. HOTELSURF operates as an intermediary service provider in accordance with the Law No. 6502 on the Protection of Consumers and relevant legislation.

2.4. Matters related to the performance of the accommodation service, service quality, facility conditions, room standards, or incomplete or defective service are solely the responsibility of the relevant accommodation provider.

3. Scope of the Service

The services provided by HOTELSURF are limited to:

presenting information about accommodation facilities on the Platform,

enabling Users to create reservation requests,

providing payment infrastructure, and

transmitting reservation information to the relevant accommodation facility.

HOTELSURF does not intervene in the content or performance of the accommodation service.

4. Formation and Acceptance of the Agreement

4.1. By creating a reservation through the Platform, the User declares that they have read, understood, and accepted these Terms of Use.

4.2. A reservation becomes valid once the payment is completed by the User and the reservation is confirmed by the relevant accommodation facility.

4.3. HOTELSURF is not responsible for reservations that are not confirmed by the accommodation facility.

5. Payment Terms

5.1. Payments made through the Platform are collected online via bank virtual POS infrastructures.

5.2. HOTELSURF does not store, record, or process credit card or debit card information.

5.3. Payment transactions are carried out by the relevant banks and authorized payment institutions in accordance with applicable regulations and security standards.

6. Right of Withdrawal

6.1. Pursuant to Article 15/g of the Regulation on Distance Contracts, there is no right of withdrawal for accommodation services that must be performed on a specific date or within a specific period.

6.2. The User declares that they are aware of and accept this condition.

7. Cancellation, Refunds and Changes

7.1. In cases such as reservation cancellation, refund, date changes, no-show (failure to check in), or early departure, the policies determined by the relevant accommodation facility shall apply.

7.2. HOTELSURF is not responsible for cancellation or refund policies applied by the accommodation facility.

8. Chargeback

8.1. Chargeback requests initiated by the User are evaluated in accordance with the rules of the relevant bank and payment institution.

8.2. HOTELSURF acts solely as an intermediary in chargeback procedures and is responsible only for providing the necessary information and documents to the bank.

8.3. HOTELSURF cannot be held responsible for any costs, deductions, or penalties that may be applied by banks or payment institutions.

9. Limitation of Liability

9.1. HOTELSURF shall not be held liable for:

disruptions arising from the accommodation facility,

incomplete or defective services,

force majeure events, or

actions of third parties.

9.2. In any case, HOTELSURF's liability is limited to the amount of the service fee collected.

10. Force Majeure

Natural disasters, epidemics, wars, strikes, decisions of public authorities, and other events beyond the control of the parties shall be considered force majeure.

11. Dispute Resolution

In disputes arising from these Terms of Use, Istanbul Courts and Enforcement Offices shall have jurisdiction, without prejudice to the authority of Consumer Arbitration Committees where applicable.

12. Entry into Force

These Terms of Use enter into force on the date they are published on the Platform and become binding once accepted by the User.
